I am Daniella Clements, a self-employed therapist. For the purposes of the General Data Protection Regulation (GDPR), I am the Data Controller. You can contact me at info@daniellaclementstherapy.com. I am registered with the Information Commissioner's Office (ICO) under registration number ZB757429.

2. The Type of Personal Information I Collect
When you use the contact form on my website or engage in my services, I collect and process the following:

  • Identity Data: Name and date of birth.

  • Contact Data: Email address and phone number.

  • Special Category Data: Sensitive health information, such as your mental health history or session notes.

 

3. How I Get the Personal Information and Why I Have It
Most of the personal information I process is provided to me directly by you for one of the following reasons:

  • To respond to an enquiry made via the website contact form.

  • To provide therapeutic services to you.

 

4. Lawful Basis for Processing
Under the UK GDPR, the lawful bases I rely on for processing this information are:

  • Contract: I need this information to carry out our therapy agreement.

  • Legitimate Interests: To ensure I provide safe and effective care.

  • Special Category Data: I process sensitive health data under Article 9(2)(h) for the provision of health or social care.

 

5. How I Store Your Information
Your information is securely stored on my business laptop, which is protected by full-disk encryptionand strong password controls. 

  • Retention: I keep your personal data and session notes for 7 years after our final session, as required by my insurance provider Howden Insurance and professional body HCPC. After this period, your data will be securely destroyed.

 

6. Your Data Protection Rights
Under data protection law, you have rights including:

  • Your right of access: You have the right to ask for copies of your personal information.

  • Your right to rectification: You have the right to ask me to rectify information you think is inaccurate.

  • Your right to erasure: You have the right to ask me to erase your personal information in certain circumstances (note: legal/insurance obligations may override this for clinical notes).
